By accessing or using this website, creating an account, or placing an order, you agree to be bound by these

Terms & Conditions. If you do not agree, you must not use this website.

1. Supplier information

This website is operated by PartsZA, a brand of BMParts (Pty) Ltd.

Business name: BMParts (Pty) Ltd trading as PartsZA
Email: sales@partsza.co.za
Phone: +27 11 609 2020 / +27 71 470 6921

South Africa’s ECTA requires suppliers offering goods or services by way of electronic transactions to make certain information available on the website.

2. Scope

  • These Terms apply to:
  • all visitors to the website
  • all users who register an account
  • all customers who place orders
  • all purchases made through the website
  • These Terms must be read together with our:
  • Privacy Policy
  • Returns Policy
  • Shipping / Delivery Policy
any product-specific terms shown on the website

3. Eligibility and use of the website

  • You may use this website only for lawful purposes and in accordance with these Terms.
  • You agree not to:
  • use the website fraudulently or for any unlawful purpose
  • interfere with the security or proper functioning of the website
  • attempt unauthorized access to any systems, accounts, or data
  • submit false, misleading, or inaccurate information
  • copy, scrape, reproduce, or commercially exploit website content without permission, except as allowed by law
  • We may suspend or restrict access to the website if we reasonably believe misuse, fraud, abuse, or unlawful activity has occurred.

4. Product information

      • We aim to ensure that product descriptions, images, pricing, compatibility notes, and availability are as accurate as reasonably possible. However:
      • images may be illustrative only
      • product colours, finishes, packaging, or labels may vary
      • compatibility references must be independently verified by the customer before purchase where applicable
      • clerical, pricing, stock, or content errors may occasionally occur
      • For automotive parts, it remains the customer’s responsibility to verify suitability using the relevant part number, VIN, model, engine code, chassis, or other technical reference where applicable.

5. Availability and stock

An item appearing as available on the website does not guarantee fulfilment if:

  • stock records are inaccurate
  • the item becomes unavailable before order processing
  • the item is damaged, discontinued, or withdrawn
  • there is an obvious listing or technical error

6. Pricing

All prices displayed on the website are shown in South African Rand (ZAR) unless stated otherwise.

Prices are subject to change without notice before an order is accepted. If a pricing error occurs, including an obvious or manifest error, we reserve the right to:

  • correct the price
  • cancel the order before dispatch
  • contact you to confirm whether you wish to proceed at the correct price

The CPA regulates fair consumer practices and consumer information standards, which is why pricing and transaction terms should be clear and not misleading.

7. Orders

Submitting an order through the website does not automatically mean that the order has been accepted.

An order is only accepted when:

      • payment authorization is successful, where applicable, and
      • we confirm acceptance or dispatch of the order
      • We reserve the right to refuse, limit, or cancel any order in our discretion, including where:
      • there is suspected fraud or abuse
      • payment cannot be verified
      • product information or pricing is incorrect
      • stock is unavailable
      • the delivery location cannot be serviced
      • the order appears commercially unreasonable or automated

8. Payment

Payment must be made using one of the payment methods made available on the website at checkout.

By submitting payment details, you warrant that:

  • you are authorized to use the selected payment method
  • the payment information provided is accurate
  • sufficient funds or authority exist to complete the transaction

We may use third-party payment processors. We do not control their services and are not liable for their downtime, banking delays, or processing failures, except to the extent required by law.

9. Delivery and shipping

Delivery is subject to our Shipping / Delivery Policy and the address supplied by the customer.

Delivery times are estimates only and are not guaranteed unless expressly stated otherwise. We are not liable for delays caused by:

      • courier issues
      • supplier delays
      • customs or regulatory processes
      • incorrect address details
      • force majeure events
      • public holidays or peak periods

10. Inspection on delivery

You should inspect your order as soon as reasonably possible after delivery.

If goods arrive damaged, incorrect, incomplete, or defective, you should notify us promptly and provide supporting details, including photographs where appropriate, so that we can assess the issue under our Returns Policy and applicable law.

11. Returns, refunds, and defective goods

Returns, exchanges, refunds, and defect-related claims are governed by:

  • our Returns Policy, and
  • applicable South African consumer law, including the CPA where applicable

Nothing in these Terms limits any rights you may have under the CPA in relation to defective goods, unfair terms, or prohibited conduct. The CPA establishes national consumer protection standards and applies to many consumer transactions in South Africa.

12. Direct marketing and cooling-off rights

If a transaction falls within the scope of direct marketing under applicable South African law, eligible consumers may have a right to cancel within the legally prescribed cooling-off period.

South African consumer guidance states that consumers have a five-business-day cooling-off period in direct marketing cases and that amounts paid must generally be refunded within 15 business days after cancellation notice, subject to the law’s requirements.

This cooling-off right does not automatically apply to every online purchase; it applies only where the law specifically provides for it.

13. Customer accounts

If you create an account, you are responsible for:

  • maintaining the confidentiality of your login details
  • restricting access to your account
  • ensuring your account information remains accurate and current

You are responsible for all activities that occur under your account unless caused by our negligence or system fault.

We may suspend or terminate accounts linked to misuse, fraud, abusive conduct, or breach of these Terms.

14. Intellectual property

All content on this website, including:

  • text
  • graphics
  • logos
  • icons
  • product listings
  • page layouts
  • design elements
  • source content created by us

You may not reproduce, distribute, adapt, publish, transmit, or exploit website content without prior written permission, except where allowed by law.

15. User submissions

If you submit reviews, comments, messages, suggestions, or other content to us, you:

  • warrant that the content is lawful and does not infringe third-party rights
  • grant us a non-exclusive, royalty-free right to use, reproduce, and display that content for operating and promoting our business
  • agree not to submit defamatory, abusive, misleading, unlawful, or infringing content

16. Website availability and technical issues

We do not guarantee that the website will always be available, uninterrupted, error-free, or free from bugs, viruses, or other harmful components.

We may suspend, withdraw, or change any part of the website without notice for maintenance, upgrades, security, or operational reasons.

17. Limitation of liability

To the fullest extent permitted by law:

  • your use of the website is at your own risk
  • we are not liable for indirect, incidental, special, or consequential loss
  • we are not liable for loss of profit, revenue, business, goodwill, or data arising from use of the website, delayed delivery, or product unavailability
  • we are not liable for third-party service interruptions, including payment gateways, hosting services, or couriers

The CPA prohibits certain unfair, unreasonable, or unjust terms and practices, so any limitation clause remains subject to applicable law.

18. Indemnity

You agree to indemnify and hold harmless PartsZA, BMParts (Pty) Ltd, and their directors, employees, contractors, and agents from claims, losses, damages, liabilities, and costs arising out of:

      • your breach of these Terms
      • your misuse of the website
      • your violation of any law or third-party rights

This applies only to the extent permitted by law.

19. Privacy and personal information

Your use of the website is also governed by our Privacy Policy.

We process personal information in accordance with applicable law, including POPIA where relevant.

20. Third-party links and services

This website may contain links to third-party websites, tools, platforms, or services. Those third-party services operate independently. We are not responsible for their availability, content, policies, or practices.

21. Changes to these Terms

We may update these Terms from time to time.

The latest version will always appear on this page with the updated effective date. Continued use of the website after changes are posted means you accept the revised Terms.

22. Governing law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising from these Terms or the use of this website will be subject to the jurisdiction of the South African courts, unless applicable law requires otherwise.

23. Complaints and dispute resolution
